What is a design?

A registered design protects the appearance of the whole or a part of a product, and it gives the owner the right to prevent competitors from imitating and copying it.

A design must be new, and the product cannot be made public before filing the registration application. An exception to this is so called grace period, which means that you are allowed to test your product on the market for up to 12 months before deciding whether to file a registration application for it. However, the grace period involves many risks. Thus it is highly recommended not to publish your design in any way before filing your registration application at the Patent Office.

Applying

Application process

After the application has been filed, the registrability of the design will be examined. If no obstacles are found, the design will be registered and published.

Further actions

A registered design in Finland is valid for five years from the filing date of the design application. The registration can be renewed four times, each time for a period of five years.  We take care of the renewals of your design and of recordals of any changes in the trademark register.

If someone is infringing your design right by using a similar design, you can take action to stop the infringement. If needed, the case can be taken to the Finnish Market Court. We assist you with different conflict and infringement situations.

International protection

If you are applying to register your product as a design and you want to invoke an earlier design right or utility model application that you have filed somewhere else, you can request priority from the earlier application within six months after you filed your first application. Priority gives you right to take precedence over others.

Design protection in Finland can be obtained through a national registration or through an EU design registration covering the entire territory of the European Union. Further, Finland can be designated in an international registration application according to Hague agreement providing a central filing system via the World Intellectual Property Organization (WIPO). An international design registration according to Hague system is recorded in the International Register and published in the International Designs Bulletin. Thereafter, the IP Offices of the designated territories will make a decision in accordance with their legislation.

If you want to protect your design only in few countries, it is often advisable to file national design applications instead of the international application according to Hague agreement.
