What is a trademark?

A trademark is a symbol that distinguishes your goods and services from those of your competitors. A trademark may be, for example, a word or a combination of words, a figurative element, a slogan, a sound or a combination of any of these. A trademark registration prevents others from using an identical or similar mark.

Trademark application

Before filing the application, we check that there are no earlier registered marks or company names which could prevent the registration of your mark. We will help you with finding out the right classification and file the application for you. We also take care of the correspondence with registrars.

Process

After the application has been filed, the registrability of the trademark will be examined. If no obstacles are found, the trademark will be published and registered. The details of the application process depend on the country/area in which protection is sought.

Further actions

A trademark is valid for 10 years from the application date, and it can be renewed every 10 years. We take care of the renewals of your trademark and of recordals of any changes in the trademark register.

In Finland it is possible to file an opposition against a registered trademark during an opposition period. We defend trademark owners in opposition processes, and protect our clients against infringers by filing oppositions against trademarks. We also safeguard your interests in other trademark conflict and infringement matters

International protection

If you are applying to register your trademark and you want to invoke an earlier trademark that you have filed somewhere else, you can request priority from the earlier application within six months after you filed your first application. Priority gives you right to take precedence over others.

Trademark protection in Finland can be obtained through a national registration, or through an EU trademark registration covering the entire territory of the European Union. Furthermore, Finland can be designated in an international registration application according to Madrid protocol providing a central filing system via the World Intellectual Property Organization (WIPO) for an applicant who has applied for or obtained registration of a trademark in a member country. An international trademark registration application according to Madrid system is recorded in the International Register and published in the WIPO Gazette of International Marks. Thereafter, the IP Offices of the designated territories will make a decision of the registrability of the trademark in accordance with their trademark legislation.

If you want to protect your trademark only in few countries, it is often advisable to file national trademark applications instead of the international application according to Madrid protocol.
